A Person operating and maintaining a Private Disposal System pursuant to this Article shall comply with any additional requirements that may be imposed by the Michigan Department of Public Health or the Michigan Department of Natural Resources.
Where a connection to the System is not available under the provisions of Article 4, Section 4, the Building Sewer shall be connected to a Private Disposal System complying with all requirements of the Chippewa County Health Department.
At such time as the System becomes available to a property served by a Private Disposal System, as provided in Article 4, Section 4, a direct connection shall be made to the Sanitary Sewer in compliance with this Ordinance; and any septic tank, cesspool or similar Private Disposal System shall be abandoned, pumped out and filled with clean sand.
In the area of the Private Disposal System all traffic shall be kept off the site to prevent compaction or excavation.
In the event the Common Expense allocation and Private Disposal System Fund are not adequate for the repair, maintenance or re-construction of the Private Disposal System, the Association may levy Special Assessments to cover such necessary costs.
The Association shall make and collect assessments against the Lots as stated in the Declaration, including without limitation those provisions with respect to the Private Disposal System and Private Disposal System Fund; In the event the Common Expense allocation and separate Fund are not adequate for the construction, repair, and maintenance of the Private Disposal System, the Association shall provide for Special Assessments to cover such necessary costs.
In order to ensure that there shall be funds readily available to repair, maintain and/or re-construct the Private Disposal System beyond routine operation and maintenance expenses (which will be paid as Common Expenses out of the general maintenance fund), the Association shall create a separate fund allocated for the Private Disposal System (the “Private Disposal System Fund”), which Private Disposal System Fund shall be part of the yearly budget.
Routine regular maintenance and repair of the Private Disposal System shall be paid for out of the general Association funds for the Common Areas; provided, however the Association shall, additionally, create and maintain the Private Disposal System Fund, as provided in Section 9.04 below.
Existing buildings on Premises to which the Public Sewer is so incidentally made available shall not be required to connect to the Public Sewer until such time as new Private Disposal System are required, or until repairs or replacement of the Private Disposal System of the premises are required, or until connection of all Premises within the area in which the Premises is located is declared a necessity by the Township for the public health and welfare.
At such time as connection to the Public Sewer is made, any Private Disposal System shall be abandoned, pumped out and filled with clean sand.
