Preexisting Stockpile Coal definition

Preexisting Stockpile Coal means coal that as of the Effective Date is contained in the Reserve of Coal. SJCC represents and warrants that the amount of the Preexisting Stockpile Coal at the time of the Effective Date is equal to or greater than 4.8 million tons. The actual amount of Preexisting Stockpile Coal as of the Effective Date (“Preexisting Stockpile Volume”) shall be allocated across to the Contract Years during the Term in accordance with methodology set forth in Exhibit M (each such annual amount, “Annual Preexisting Stockpile Amount”). The Parties acknowledge and agree that the Annual Preexisting Stockpile Amount shall be zero (0) in certain Contract Years.

Examples of Preexisting Stockpile Coal in a sentence

  • In the event of an SJCC Environmental Force Majeure, then Available Pre-existing Stockpile Tons will be allocated in the same manner as Pre-existing Stockpile Coal tons, and Force Majeure Tons will be allocated in the same manner as Tier 1 Tons unless otherwise approved by the Remaining Participants in the Fuels Committee.

  • Non-Retail Behind The Meter Generation means Behind the Meter Generation that is used by municipal electric systems, electric cooperatives, or electric distribution companies to serve load.

  • Invasive plant species means species of plants not historically found in California that spread outside cultivated areas and can damage environmental or economic resources. Invasive species may be regulated by county agricultural agencies as noxious species. Lists of invasive plants are maintained at the California Invasive Plant Inventory and USDA invasive and noxious weeds database.

  • Asphalt means a dark brown to black cement-like material (solid, semisolid, or liquid in consistency) in which the predominating constituents are bitumens which occur in nature as such or which are obtained as residue in refining petroleum.

  • Open type traction battery means a type of battery requiring liquid and generating hydrogen gas released to the atmosphere.

  • Harvested Material means the grain or fodder from crops of the Licensed Varieties grown from Seed or Retained Seed.
