Powered Paragliding definition

Powered Paragliding means all acts related to powered paragliding or non-powered paragliding at or with UPNCPPG, including, but not limited to, procuring, assembling, preparing, maintaining, repairing, boarding, disembarking or jumping from, launching, flying, landing, crashing, piloting, driving, riding in, pushing, pulling, starting, turning-off, being in the general area of, observing, and watching a powered paraglider or non-powered paraglider. "Powered Paragliding" also includes the training, instruction, and other advice you receive from UPNCPPG, preparation of the parachutes, gear, instruments, and other items or equipment used or available when powered paragliding or non-powered paragliding.

Examples of Powered Paragliding in a sentence

  • You represent that you will remain solely responsible for your own actions, even if UPNCPPG was negligent in its instruction and training of you, and its preparation and maintenance of your Powered Paragliding aircraft.

  • These inherent dangers and risks will always be present with Powered Paragliding, even if you or UPNCPPG is an expert in Powered Paragliding and have never experienced or witnessed any injury or death when Powered Paragliding.

  • You represent that you possess the physical fitness and ability necessary to safely participate in Powered Paragliding without creating unnecessary risk of harm to yourself, UPNCPPG, or any Third Party.

  • You represent that you will not ingest or otherwise consume any legal or illegal drugs (including prescription and over-the-counter medications), alcohol, or any other stimulants or sedatives prior to or during Powered Paragliding that may decrease your ability to safely engage in Powered Paragliding or create any unnecessary risk of harm to yourself, UPNCPPG, or any Third Party.

  • You voluntarily, willingly, and knowingly assume any and all dangers and risks associated with Powered Paragliding, whether those risks are known or unknown, including those that may result in Injury or death.

  • Examples of the risks you assume include, but are not limited to, equipment malfunction, UPNCPPG's negligent training, instruction, and maintaining of equipment, deficiencies in the landing or launch area, complications caused by the weather, and unforeseen or unpredictable occurrences while Powered Paragliding.

  • You have the physical ability to engage in strenuous, intense, and sometimes life-threatening conditions that may occur during Powered Paragliding.

  • You represent that you do not suffer from any physical infirmities, disabilities, or illnesses that might hinder your ability to engage in Powered Paragliding without causing unnecessary risk to yourself, UPNCPPG, or Third Party, including, but not limited to, heart conditions, fainting, seizures, memory loss, poor vision or hearing, and dizzy spells.

  • Before UPNCPPG will engage in any Powered Paragliding services or activities with you, you must make certain truthful, voluntary representations to UPNCPPG.

  • You agree that if you suffer any Injury or death when Powered Paragliding, you, on behalf of yourself and your Estate, release and discharge UPNCPPG, and the owners of the property you fly over, take off from, or land or crash on, from any liability for any Damages resulting from your Injury or death, even if those Damages result from Injury or death caused UPNCPPG's negligence or other act or omission.
