Post Tender Negotiations means the ability to negotiate with a Tenderer after a Tender has been opened and evaluated in accordance with the published evaluation criteria for the purposes of securing an improvement in the delivery of the Contract including but not limited to improvements in price.

  • It is understood and agreed by the parties that if any part, term, condition, or provision of this Agreement is held to be illegal or in conflict with any law of this state or the United States, the validity of the remaining parties, terms, conditions, or provisions shall not be affected, and the rights and obligations of the parties shall be construed and enforced as if the Agreement did not contain the particular part, term, condition, or provision held to be invalid.

  • Open Tenders means the tenders invited in open and public manner and with adequate notice.

  • Limited Tenders means tenders invited from all or some Contractors on the approved or select list of Contractors with the Railway.

  • Invitation to Negotiate means a written solicitation for competitive sealed replies to select one or more vendors with which to commence negotiations for the procurement of commodities or services.

  • Bidder/Tenderer means the interested Firm/ Company that may provide or provides related goods / services to any of the public/ private sector organization under the contract and have registered for the relevant business thereof.

  • Request for Tender means the Request for Tender given to prospective tenderers inviting offers to tender for the supply of the Goods and Services of which these General Conditions of Contract form part.

  • Invitation to Tender or "ITT" means the Invitation to Tender issued by the Authority on 14/11/2012;

  • Service and support administrator means a person, regardless of title, employed by or under contract with a county board to perform the functions of service and support administration and who holds the appropriate certification in accordance with rule 5123:2-5-02 of the Administrative Code.

  • Notice of Proposal to Negotiate has the meaning set forth in Section 10(c) hereof.

  • Patent Security Agreement means each Patent Security Agreement executed and delivered by Grantors, or any of them, and Agent, in substantially the form of Exhibit B.
