Pollutant or contaminant definition

Pollutant or contaminant means any element, substance, compound, or mixture, which after release into the environment and upon exposure, ingestion, inhalation, or assimilation into any organism either directly from the environment or indirectly by ingestion through food chains, will or may reasonably be anticipated to cause death, disease, behavioral abnormalities, cancer, genetic mutation, physiological malfunctions (including malfunctions in reproduction) or physical deformations, in such organisms or their offspring.

Release: Any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing of hazardous substances, pollutants or contaminants into the environment including the abandonment or discarding of barrels, containers and other closed receptacles containing any hazardous substance, pollutant, or contaminant. It excludes: (a) any release which results in exposure to persons solely within a work place; (b) emissions from the engine exhaust of a motor vehicle, rolling stock, aircraft, vessel, or pipeline pumping station engine; and (c) the normal application of fertilizer.

Pollutant or contaminant as defined in the Minnesota Environmental Response and Liability Act, Minnesota Statutes, Section 115B.02. The term also includes, but is not limited to polychlorinated biphenyls, asbestos, urea formaldehyde or related substances. Tenant shall, at Tenant's own expense, comply with all laws regulating the use, generation, storage, transportation, or disposal of Hazardous Substances ("Laws"). Tenant shall, at Tenant's own expense, make all Submissions to, provide all information required by, and comply with all requirements of all governmental authorities (the "Government") under the Laws. Should any Government or any third party demand that a cleanup plan be prepared and that a clean-up be undertaken because of any deposit, spill, discharge, or other release of Hazardous Substances that occurs during the term of this Lease, at or from the Leased Premises, or which arises at any time from Tenant's use or occupancy of the Leased Premises, then Tenant shall, at Tenant's own expense, prepare and submit the required plans and all related bonds and other financial assurances; and Tenant shall carry out all such cleanup plans. Tenant shall promptly provide all information regarding the use, generation, storage, transportation, or disposal of Hazardous Substances that is requested by the Lessor. If Tenant fails to fulfill any duty imposed under this Paragraph 8 within a reasonable time, the Lessor may do so and, in such case, Tenant shall cooperate with the Lessor in order to prepare all documents the Lessor deems necessary or appropriate to determine the applicability of the Laws to the Leased Premises and Tenant's use thereof, and for compliance therewith, and Tenant shall execute all documents promptly upon the Lessor's request. No such action by the Lessor and no attempt made by the Lessor to mitigate damages under any law shall constitute a waiver of any of Tenant's obligations under this Paragraph 8.   • Regulated NSR pollutant means the following:

  • Air contaminant means dust, fumes, mist, smoke, other particulate matter, vapor, gas, odorous substances, or any combination thereof.

  • Regulated air pollutant means the following:

  • Air contaminant source means any and all sources of emission of air contaminants whether privately or publicly owned or operated (Section 19-2-102(2)).

  • Hazardous Materials does not include products or materials that are commonly used in construction or industrial practice so long as they are used in accordance with the manufacturer’s instructions or Material Safety Data Sheets issued for the product or materials. (See Article 1.6.3 below.)
