Plaintiff Settlement Class definition

Plaintiff Settlement Class means all persons and entities who (a) purchased Clearwire’s retail services between November 14, 2004, and February 27, 2012, and (b) provided Clearwire with a billing address in the United States.

  • None of the rights, commitments, or obligations recognized under this Agreement may be assigned by any member of the Plaintiff Settlement Class without the express written consent of the other Parties.

  • The certification of the Plaintiff Settlement Class shall have no bearing in deciding whether the claims asserted in the Action are or were appropriate for class treatment in the absence of settlement.

  • The RMG Defendants further maintain that Plaintiff, Settlement Class Members and any other persons contacted by the RMG Defendants are not entitled to relief under the TCPA in this Action.

  • The Cruise Defendants also specifically deny that they approved the RMG Defendants’ use of any automated pre-recorded telephone calls to Plaintiff, Settlement Class Members and any other persons either before or after the commencement of the Action and that the evidence unequivocally proves this to be the case.

  • How will the lawyers be paid, and will the Plaintiff Settlement Class Representatives receive incentive awards?Class Counsel have prosecuted this case on a contingency basis.

  • Therefore, the Cruise Defendants maintain that Plaintiff, Settlement Class Members and any other persons contacted by the RMG Defendants are not entitled to relief under the TCPA in this Action.


More Definitions of Plaintiff Settlement Class

Plaintiff Settlement Class means all persons who fall within the class definitions as certified in the Litigation (defined below) and as specified in the Court’s March 10, 2020 Order Granting Motion for Class Certification.

Related to Plaintiff Settlement Class

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Ontario Settlement Class means the settlement class in respect of the Ontario Action as defined in Schedule A.

  • Settlement Class Members means a Person(s) who falls within the definition of the Settlement Class.

  • Settlement Classes means the following:

  • Settlement Class Counsel means Xxxx X. Xxxxx and Xxxxxx X. Xxxxxx of Xxxxxxxxx Xxxxxx & Xxxxx XXX, Xxxx X. Xxxxx of The Rhine Law Firm, P.C., and Xxxx Xxxxxxxxx of Xxxxxxxxx & Xxxxxx P.A.

  • Settlement Class Member means a member of a Settlement Class.

  • Settlement Class Period means the period January 1, 2006 through January 31,

  • Non-Settling Defendants means any Defendant that is not a Releasee and includes any Defendant that terminates its own settlement agreement in accordance with its terms or whose settlement otherwise fails to take effect for any reason, whether or not such settlement agreement is in existence at the Execution Date.

  • Final Settlement means permanent settlement of the Contractor’s actual allowable costs or expenditures as determined at the time of audit, which shall be completed within three years of the date the year-end cost settlement report was accepted for interim settlement by the State. If the audit is not completed within three years, the interim settlement shall be considered as the final settlement.

  • Settlement Cycle means the period of Clearance System Business Days following a transaction on the Relevant Exchange in the Underlying, during which period settlement will customarily take place according to the rules of such Relevant Exchange.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Individual Settlement Payment means the amount payable from the Net

  • Non-Settling Defendant means any Defendant that is not a Settling Defendant or any Defendant that has not entered into a binding and approved settlement with the Plaintiffs in the Proceedings, whether or not such settlement agreement is in existence at the Date of Execution, and includes any Defendant that terminates its own settlement agreement in accordance with its terms or whose settlement otherwise fails to take effect for any reason, whether or not such settlement agreement is in existence at the Date of Execution.

  • ASX Settlement means ASX Settlement Pty Ltd (ABN 49 008 504 532);

  • Released Class Claims means the claims being released as described in Paragraph 6.2 below.

  • Viatical settlement provider means a person, other than a viator, who enters into or effectuates a viatical settlement contract. Viatical settlement provider does not include:

  • PJM Settlement or “PJM Settlement, Inc.” shall mean PJM Settlement, Inc. (or its successor), established by PJM as set forth in Section 3.3 of the Operating Agreement.

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.

  • Resettlement Action Plan or “RAP”, means a plan approved by the Association, to be prepared in accordance with the provisions of the RPF, setting forth principles and procedures governing land acquisition or other associated Project impacts, resettlement and compensation of Affected Persons, as well as reporting and monitoring arrangements to ensure compliance with the said plan, as the same may be amended from time to time with the agreement of the Association, and “Resettlement Action Plans” or “RAPs” shall mean such Resettlement Action Plans, collectively.

  • Master Settlement Agreement means the settlement agreement and related documents entered into on November 23, 1998, by the state and leading United States tobacco product manufacturers.

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Preferred claim means a claim with respect to which the terms of this chapter accord priority of payment from the general assets of the insurer.

  • Final Settlement Date has the meaning set forth in Section 2.4(c).

  • Final Settlement Statement has the meaning set forth in Section 2.6(b).

  • Class Members means all individuals in the Settlement Class, including the Class Representatives.

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.
