Physical Supplier definition

Physical Supplier means Nordic Marine Oil A/S or a third party appointed by the Seller to deliver the Bunkers to the Vessel, as applicable. Where Nordic Marine Oil A/S has Bunkers available for delivery, Nordic Marine Oil A/S will, from time to time, act as both Seller and Physical Supplier.
Physical Supplier means the person who physically supplies the Product to the Vessel together with that person’s servants, agents, successors, subcontractors and assigns. The Physical Supplier may be the Seller or any other person
Physical Supplier means the supplier of the Fuels delivered to the Vessel where the Company has undertaken solely to sell the Fuels.

Examples of Physical Supplier in a sentence

  • The Seller shall deliver the quantity of Products stated in the Order Confirmation, unless the Physical Supplier for whatever reason is unable to deliver the full quantity, in which case the Buyer shall have no claim against the Seller and the Seller shall only invoice for the actual quantity delivered.

  • The Seller shall be under no obligation to make deliveries when a clear and safe berth, position or anchorage is not available, which shall be solely at the discretion of the Physical Supplier to determine.

  • Neither the Seller nor the Physical Supplier shall be required to remove any such cause or replace any affected source or supply or facility if doing so shall involve additional expense.

  • In the event of a dispute regarding the quality of the Products delivered, no other samples than the samples drawn pursuant to this clause, and which are kept by the Seller and/or the Physical Supplier, may be tested, unless the parties have specifically agreed otherwise.

  • The Seller and/or the Physical Supplier shall not be liable for any time lost or other consequences caused by circumstances preventing the commencement or completion of the bunkering operation.
