Physical attack means the direct or indirect application of force by a person to the body of, or to clothing or equipment worn by another person, where that application creates a risk to health and safety.
Physical attack. The intentional and unlawful touching of an employee of the Board of Education so as to cause actual physical disability. Physical attack does not include the intentional or negligent infliction of emotional harm to an employee of the Board of Education. Physical Disability: The substantial and material impairment of the employee’s ability to perform any substantial part of his ordinary duties. Physical disability does not include the mental impairment of the employee’s ability to perform his ordinary duties. In all cases, the Board of Education shall determine whether the employee has suffered a substantial and material impairment of his ability to perform any substantial part of his ordinary duties.
