Pfizer Confidential Information means (a) all Results (as defined in Section 1.19) and Program Technology, and (b) all other information about any element of Pfizer Technology, including, without limitation, protocols, which Pfizer discloses to Xenogen Cranbury and designates as “Confidential,” where such disclosure is either in writing or within 30 days of such disclosure Pfizer provides Xenogen Cranbury a memorandum identifying the disclosure and characterizing it as confidential. Notwithstanding the foregoing, “Pfizer Confidential Information” shall not include any information that (i) at the time of disclosure to Xenogen Cranbury, is already known by Xenogen Cranbury other than by virtue of a prior confidential disclosure to Xenogen Cranbury by Pfizer; or (ii) is or becomes disclosed in published literature, or otherwise is or becomes generally known to the public, in each case through no fault or omission of Xenogen Cranbury; or (iii) is obtained by Xenogen Cranbury from a third party free from any obligation of confidentiality to Pfizer.
Pfizer Confidential Information means all information about any element of Pfizer or Joint Technology which is disclosed by Pfizer to Peptide and designated "Confidential" in writing by Pfizer at the time of disclosure to Peptide to the extent that such information as of the date of disclosure to Peptide is not (i) known to Peptide other than by virtue of a prior confidential disclosure to Peptide by Pfizer; or (ii) disclosed in published literature, or otherwise generally known to the public through no fault or omission of Peptide; or (iii) obtained from a third party free from any obligation of confidentiality to Pfizer.
Pfizer Confidential Information means all information relating to PFIZER Technology or PFIZER Program Technology, as well as any other information regarding the technology, business and operations of PFIZER of any of its Affiliates, that is or has been disclosed (whether orally or in writing) by PFIZER or its Affiliates to PSIVIDA or its Affiliates to the extent that such information is not (i) as of the date of disclosure known to PSIVIDA or its Affiliates; or (ii) disclosed in published literature, or otherwise generally known to the public through no breach by PSIVIDA of this Agreement; or (iii) obtained by PSIVIDA or its Affiliates from a Third Party free from any obligation of confidentiality to PFIZER; or (iv) independently developed by PSIVIDA or its Affiliates without use of the PFIZER Confidential Information; or (v) required to be disclosed under Law; provided that, in the case of (v), PSIVIDA provides PFIZER prior notice (to the extent practicable) of such disclosure and agrees to cooperate, at the request and sole expense of PFIZER, with PFIZER’s efforts to preserve the confidentiality of such information.

All information about the existence and terms of this Agreement shall be considered both Incyte Confidential Information and Pfizer Confidential Information.
All Pfizer Development Reports and Development Plans for Pfizer Products shall be deemed Pfizer Confidential Information.
More Definitions of Pfizer Confidential Information
Pfizer Confidential Information means all information about any element of Pfizer Technology or Program Technology, except for Program Technology assigned to Rigel pursuant to Section 5.1, which is disclosed by Pfizer to Rigel and designated "Confidential" in writing by Pfizer at the time of disclosure or within thirty (30) days following disclosure to Rigel to the extent that such information as of the date of disclosure to Rigel is not (i) demonstrably known to Rigel other than by virtue of a prior confidential disclosure to Rigel by Pfizer; (ii) disclosed in published literature, or otherwise generally known to the public through no fault or omission of Rigel; or (iii) obtained from a third party free from any obligation of confidentiality to Pfizer prior to disclosure to Rigel by Pfizer.
Pfizer Confidential Information means all information relating to Licensed Products, as well as any other information regarding the business and operations of Pfizer, that is or has been disclosed (whether orally or in writing) by Pfizer to Lpath or its Affiliates to the extent that such information is not (i) as of the date of disclosure known to Lpath or its Affiliates other than under an obligation of confidentiality; or (ii) disclosed in published literature, or otherwise generally known to the public through no breach by Lpath; of this Agreement or (iii) obtained by Lpath or its Affiliates from a Third Party free from any obligation of confidentiality; or (iv) independently developed by Lpath or its Affiliates without use of or reference to the Pfizer Confidential Information.
Pfizer Confidential Information means information which has prior to the date hereof been or which at any time hereafter is disclosed in writing and marked "Confidential" (or if disclosed orally, is reduced to writing within thirty (30) days of disclosure) directly or indirectly by PFIZER or by any of its Affiliates or agents or agents of its Affiliates to XXXXXX- XXXXXXX or any of its Affiliates or agents or agents of its Affiliates in connection with this Agreement and which relates to the business of PFIZER.

Pfizer Confidential Information means all information relating to the Compound or Licensed Product, as well as any other information regarding the business and operations of Pfizer, that is or has been disclosed (whether orally or in writing) by Pfizer to Protalix or its Affiliates to the extent that such information is not: (a) as of the date of disclosure known to Protalix or its Affiliates; or (b) disclosed in published literature, or otherwise generally known to the public through no breach by or Protalix; of this Agreement or (c) obtained by Protalix or its Affiliates from a Third Party free from any obligation of confidentiality to Pfizer; or (d) independently developed by Protalix or its Affiliates without use of the Pfizer Confidential Information; or (e) in the good faith judgment of Protalix, after consultation with legal counsel, is required to be disclosed under Law; provided that, in the case of (e), Protalix provides Pfizer prior notice (to the extent practicable) of such disclosure and agrees to cooperate, at the request and sole expense of Pfizer, with Pfizer’s efforts to preserve the confidentiality of such information.
