PERSONNEL DISCLOSURE. ‌ 26.1 This Paragraph 26 applies to all of CONTRACTOR’s personnel providing services through this Contract, paid and unpaid, including those identified in Paragraph 15 of Attachment A (hereinafter referred to as “Personnel”). 26.2 CONTRACTOR shall make available to ADMINISTRATOR a current list of all Personnel providing services hereunder, including résumés and job applications. Changes to the list will be immediately provided to ADMINISTRATOR, in writing, along with a copy of a résumé and/or job application. PERSONNEL DISCLOSURE. A. Where authorized by law, the Commission, CHS, CBO and CDN’s employment and/or volunteer applications shall require applicants to provide detailed information regarding the conviction of a crime by any court, for offenses other than minor traffic offenses. Information not disclosed in the application discovered subsequent to the hiring or promotion of any applicant shall be cause for termination of that employee from the performance of services under this Agreement. B. Where authorized by law, the Commission, CHS, CBO and CDN shall conduct, at no cost to COUNTY, Child Abuse Central Index, U.S. Department of Justice National Sex Offender Website (▇▇▇.▇▇▇▇▇.▇▇▇), Megan’s Law Sex Offender Registry (▇▇▇.▇▇▇▇▇▇▇▇▇.▇▇.▇▇▇), and criminal record background checks on all employees and/or volunteers who provide direct services to clients under this Agreement. Candidates will satisfy background checks consistent with and comparable to those required for COUNTY employees with this Paragraph and their performance of services under this Agreement. C. The Commission, CHS, CBO and CDN warrants that all persons employed or otherwise assigned to provide services under this Agreement have satisfactory past work records and/or reference checks indicating their ability to perform the required duties and accept the kind of responsibility anticipated under this Agreement. The Commission, CHS, CBO and CDN shall maintain records of background investigations and reference checks undertaken and coordinated for each employee and/or volunteer assigned to provide services under this Agreement for a minimum of five (5) years after the termination of this MOU. D. The Commission, CHS, CBO or CDN shall immediately notify SSA concerning the arrest and/or subsequent conviction, for offenses other than minor traffic offenses, of any paid employee and/or volunteer staff performing services under this Agreement, when such information becomes known to the Commission, CHS, CBO or CDN. SSA may determine whether such employee and/or volunteer may continue to provide services under this Agreement and shall provide notice of such determination in writing. The Commission, CHS, CBO or CDN’s failure to comply with SSA’s decision shall be deemed a material breach of this MOU. E. COUNTY has the right to approve or disapprove of all staff performing work hereunder and any proposed changes in staff. F.
