Permitted Capital Expenditures definition

Permitted Capital Expenditures has the meaning given that term in Section 9.12(b).
Permitted Capital Expenditures means Capital Expenditures (a) incurred for the purpose of permitting (i) any Loan Parties or any Project to comply with applicable Requirements of Law (including any Environmental Laws) and Applicable Permits or (ii) each Project to operate in accordance with the Base Case Projections, (b) as required to operate each Project in accordance with Prudent Industry Practices or (c) under emergency circumstances to resume or maintain operation of any Project in accordance with Prudent Industry Practice or to avoid imminent threat to human life or property.
Permitted Capital Expenditures means as specified in Section 10.6.

  • Permitted Capital Expenditures shall not include costs for any necessary repairs to remedy any broken or damaged Improvements, all of which costs shall be separately funded by Tenant.

More Definitions of Permitted Capital Expenditures

Permitted Capital Expenditures means (a) any capital expenditure or commitment to make capital expenditures which will not be completely funded by the later of December 31, 2017 and the Closing Date, and which will not involve a total liability after such date of an amount equal to or less than Three Hundred Thousand Dollars ($300,000) individually or One Million Dollars ($1,000,000) in the aggregate; (b) those capital expenditures that are set forth on Schedule 5.5; or (c) those capital expenditures otherwise agreed to by the Parties.
