Performance Deficiencies definition

Performance Deficiencies means a determination by the Company in the Company’s sole and absolute discretion that the employee provided his or her best efforts and the employee’s job performance does not meet the performance objectives or standards for the employee’s position.

Examples of Performance Deficiencies in a sentence

  • If during the Company Suspension Period the Executive does not eliminate or remedy all of the Performance Deficiencies to the Company’s reasonable satisfaction, the Company Notice will take effect, and the Executive’s employment will terminate, at the close of business on the fifth business day following the end of the Company Suspension Period pursuant to the Company Notice (a “Termination for Performance Deficiencies”).

  • If during the Company Suspension Period the Executive eliminates or remedies all of the Performance Deficiencies to the Company’s reasonable satisfaction, the Company Notice will be deemed to have been withdrawn and the Executive’s employment will continue in accordance with this Agreement.

  • Nothing in this subsection limits during the Company Suspension Period the Company’s right to terminate the Executive’s employment in accordance with subsection (a) of this section or section 6 for any reason other than the Performance Deficiencies specified in the Company Notice.

  • All Solution Performance Deficiencies, for the purpose of determining the applicable Deficiency Resolution Time and County remedies, including Service Credits, will be deemed Severity Level 1 or Severity Level 2, as determined by County Project Director.

  • All System Performance Deficiencies shall be deemed at a minimum Priority Level 2 for the purpose of the correction of Deficiencies and other County remedies.

  • Performance Deficiencies / Notice At any time deficiencies in performance are recognized.

  • Performance Deficiencies: Performance deficiencies are defined as failure to perform quality services for maintenance, repairs, or occasional installations in accordance the Agreement’s specifications, installation of inferior parts and materials, or labor performed by unknowledgeable or improperly trained staff.

  • If at any time during the term of the Contract, the County determines Service Provider is identified as either suspended or debarred on the ▇▇▇, Service Provider shall be considered in material breach of the Contract, and the County may proceed under the Correction of Performance Deficiencies section of the Contract, including immediate termination of the Contract.

  • Credits will accrue for Unscheduled Downtime and System Performance Deficiencies, including Contractor’s failure to meet the System Availability requirements and/or System or Service Response Time requirements (hereinafter “Service Credit(s)”).

  • Continued Performance Deficiencies or failure to follow the improvement plan by the VENDOR will be grounds for the DEPARTMENT to terminate this Contract in accordance with the terms and conditions established herein.

Related to Performance Deficiencies

  • Performance audit means an objective and systematic assessment of a state agency or agencies or any of their programs, functions, or activities by the state auditor or designee in order to help improve agency efficiency, effectiveness, and accountability. Performance audits include economy and efficiency audits and program audits.

  • Performance Measure means one or more of the following selected by the Committee to measure Company, Affiliate, and/or business unit performance for a Performance Period, whether in absolute or relative terms (including, without limitation, terms relative to a peer group or index): basic, diluted, or adjusted earnings per share; sales or revenue; earnings before interest, taxes, and other adjustments (in total or on a per share basis); basic or adjusted net income; returns on equity, assets, capital, revenue or similar measure; economic value added; working capital; total shareholder return; and product development, product market share, research, licensing, litigation, human resources, information services, mergers, acquisitions, sales of assets of Affiliates or business units. Each such measure shall be, to the extent applicable, determined in accordance with generally accepted accounting principles as consistently applied by the Company (or such other standard applied by the Committee) and, if so determined by the Committee, and in the case of a Performance Compensation Award, to the extent permitted under Code Section 162(m), adjusted to omit the effects of extraordinary items, gain or loss on the disposal of a business segment, unusual or infrequently occurring events and transactions and cumulative effects of changes in accounting principles. Performance Measures may vary from Performance Period to Performance Period and from Participant to Participant, and may be established on a stand-alone basis, in tandem or in the alternative.

  • Performance Test means all operational checks and tests required to determine the performance parameters including inter-alia capacity, efficiency and operating characteristics of the Stores as specified in the Contract.

  • Energy savings performance contract means a contract under which the rate of payments is based upon energy and operational cost savings and a stipulated maximum energy consumption level over the life of the contract.

  • Erroneous Payment Return Deficiency has the meaning assigned to it in Section 8.09(d).
