Penalty Claim definition

Penalty Claim means any Claim for a fine, penalty, or forfeiture, or for multiple, exemplary, or punitive damages, arising before the Petition Date, to the extent that such fine, penalty, forfeiture, or damages are not compensation for actual pecuniary loss suffered by the Holder of such Claim as set forth in section 726(a)(4) of the Bankruptcy Code.
Penalty Claim means a claim where we decide that you are at fault, partially at fault or where you cannot provide the details of the person at fault.
