Payout Criterion definition

Payout Criterion of a Contract means the Expiration Value or range of Expiration Values that will cause that Contract to pay a Settlement Value to the holder of a long position or the holder of a short position in such Contract. The holder of a long or short position in a Contract that receives a Settlement Value is considered to be “in-the-money” while the holder of either a long or short position in a Contract that does NOT receive a Settlement Value is considered to be “out-of-the-money”.
Payout Criterion of a Contract means the Expiration Value or set of Expiration Values that will cause that Contract to pay a Settlement Value to the holder of a long position in such Contract. The holder of a

Payout Criterion. The Payout Criterion for the Contract encompasses the Expiration Values that contain a ruling that results in a <complete/partial> petitioner victory. The petitioners are Students for Fair Admissions, Inc. If the value of <complete/partial> is “complete”, then only a ruling that institutions of higher education that receive federal financial assistance cannot use race as a factor in admissions to institutions of higher education that receive federal funding is encompassed in the Payout Criterion. Related to Payout Criterion

  • Performance Objective means a standard established by the Committee to determine in whole or in part whether a Performance Award shall be earned.

  • Performance Goal means a performance goal established by the Committee pursuant to Section 10.3.

  • Performance Measure means one or more of the following selected by the Committee to measure Company, Affiliate, and/or business unit performance for a Performance Period, whether in absolute or relative terms (including, without limitation, terms relative to a peer group or index): basic, diluted, or adjusted earnings per share; sales or revenue; earnings before interest, taxes, and other adjustments (in total or on a per share basis); basic or adjusted net income; returns on equity, assets, capital, revenue or similar measure; economic value added; working capital; total shareholder return; and product development, product market share, research, licensing, litigation, human resources, information services, mergers, acquisitions, sales of assets of Affiliates or business units.   • Performance Factor means any matter that could or will significantly affect a party’s ability to fulfill its obligations under this Agreement;
