The Paragraph headings in this Agreement are for reference only and shall not limit or otherwise inform the Paragraphs' meaning.
In the event Associate obtains any legally binding determination that one or more Paragraphs of this Agreement is unenforceable by application of law, the remaining Paragraphs nevertheless shall be enforceable to the full extent permitted by law; provided, however, in such event, ▇▇▇▇▇▇▇ may elect to terminate ▇▇▇▇▇▇▇'▇ and Associate's remaining obligations under this Agreement by sending Associate written notice of that election within thirty (30) days of any final legal declaration of unenforceability.
Notwithstanding the foregoing in Paragraphs 4 and 5 above, these releases and waivers shall not apply to any claim for unemployment or workers' compensation, or a claim that by law is non-waivable.
The additional payments, consideration and benefits described in Paragraphs 1–7, 10, 11, and 14–17 above are in lieu of any payments under the ▇▇▇▇▇ Corporation Severance Benefits Plan and/or any other applicable Company policies and are contingent on your executing and not revoking this Agreement and the Supplemental Release.
