Each and all Aggrieved Employee, on behalf of themselves and their respective former and present representatives, agents, attorneys, heirs, administrators, successors, and assigns, shall be deemed to release MSMU and the Released Parties from all claims for PAGA penalties for all claims that were alleged, or reasonably could have been alleged, based on the PAGA Period facts alleged in the Operative First Amended Complaint and in the PAGA Notice, and arising during the PAGA Period.
The number Class Period and number of PAGA Period pay periods you worked according to MSMU’s records is stated on the first page of this Notice.
This means that all Aggrieved Employees, including those who opt- out of the Class Settlement, cannot sue, continue to sue, or participate in any other PAGA claim against MSMU or the Released Parties based on the PAGA Period facts alleged in the Action and resolved by this Agreement.

The Administrator will calculate Individual PAGA Payments by (a) dividing $30,000.00 by the total number of PAGA Pay Periods worked by all Aggrieved Employees and (b) multiplying the result by the number of PAGA Period Pay Periods worked by each individual Aggrieved Employee.
