The value of each PAGA Pay Period shall be determined by the Settlement Administrator by dividing the 25% of the PAGA Award allocated for PAGA Employees by the Total PAGA Pay Periods for all PAGA Employees (“PAGA Pay Period Value”).
The Administrator will resolve Workweek and/or PAGA Pay Period challenges based on your submission and on input from Class Counsel (who will advocate on behalf of Participating Class Members) and Defense Counsel.
The Administrator will divide the 25% portion of the PAGA Penalties attributed to Aggrieved Employees, i.e., $50,000.00, by the PAGA Pay Periods worked by all Aggrieved Employees during the PAGA Period resulting in the PAGA Pay Period Value and then multiplying the PAGA Pay Period Value by the number of PAGA Pay Periods worked by each individual Aggrieved Employee during the PAGA Period.
The Individual PAGA Payment shall be calculated by dividing $6,250 by the total number of Aggrieved Employees in the PAGA Group and multiplying the result by the number of PAGA Pay Period the Aggrieved Employee worked within the PAGA Period.
The initial calculation prior to the mailing of the Class Notice shall estimate (1) the gross Individual Settlement Payment that each Settlement Class Member may be eligible to receive based on their Workweeks at Issue, assuming that no Class Members opt out of the Class Settlement; and (2) the gross PAGA Payment that each PAGA Releasee may be eligible to receive based on the PAGA Pay Period.
