There are no written or, to the Knowledge of the Company, oral leases, subleases, licenses or other agreements granting to any party or parties the right of use or occupancy with respect to any portion of the Owned Real Property, except for the Permitted Encumbrances.
Schedule 3.24 of the Company Disclosure Schedules contains a complete and correct list of all water sharing agreements with respect to the Owned Real Property.
The Company has delivered to Acquiror copies of all water sharing agreements or similar arrangements relating to the use of water with respect to the Owned Real Property in the Company’s actual possession.
