Having examined all the material submitted to it, the Court considers that the Government have not put forward any fact or argument capable of justifying the delay in the present case.In particular, the Court considers that the fact that the domestic authorities had to deal with a complex case which involved a number of defendants and concerned charges of organised crime cannot in itself justify the overall length of the proceedings.
The initial Conversion Price per share for shares of Series B Preferred Stock shall be the Original Series B Issue Price; provided, however, that the Conversion Price for shares of Series B Preferred Stock shall be subject to adjustment as set forth in subsection 4(c) below.
