All above and below ground tanks currently in use on the Operations Property are being used and maintained in accordance with all Applicable Laws.

Seller has received no notice that Seller has any direct or contingent liability or obligation for or in connection with any claimed release, discharge or leak caused by Seller of any Hazardous Materials into the environment and no portion of the Operations Property is listed on the CERCLIS list or the National Priorities List of Hazardous Waste Sites or any similar list maintained by the State of Florida.
Seller has never owned, leased or otherwise occupied, had an interest in or operated any real property other than the Operations Property.
