If requested by the Client, the Supplier shall provide translations of the Sports Rules and all pre-match, live and other offerings in any of the languages supported by the Supplier from time to time, provided always that (subject to Clause 14.1) the Supplier shall not be liable for any claim, problem or issue arising as a result of any such translation being incorrect and any such claim, problem or issue will not constitute an Operational Issue.
If the Client breaches this Clause 7.3: (i) the Client shall be solely liable for any resulting Loss relating to Customers and any such Loss will not constitute an Operational Issue; and (ii) subject to Clause 14.1, the Supplier shall have no liability to the Client where such liability is caused wholly or partially by the Client’s breach of this Clause 7.3 The Client shall, upon written request by the Supplier, promptly provide a copy of the Customer Terms to the Supplier.
This paragraph 7 shall not apply to the extent that any Software Error gives rise to any Operational Issue, in which case Clause 15 above shall apply.
Once an Operational Issue has been identified to the JPT through notice by either or both Project Team Leaders, the Project Team Leaders shall assign appropriate members of the JPT and/or the JPSTs to investigate, confirm and resolve any such Operational Issue(s) if such issue is not already the subject of such efforts; provided, however, that this resolution process excludes Batch-specific deviations and any quality disposition decisions related to specific Batches.
If issues are encountered, submit a short Description of Operational Issue that identifies the problem and resolution to the CAM.
Accordingly, each Party shall have the right to initiate the resolution process set forth below upon its good faith determination of or good faith belief in the existence of an Operational Issue.
A matter is considered “in dispute” when it has not been satisfactorily agreed upon through normal discussions or, if applicable, the Operational Issue Resolution Process as set out in section 5.2 of this Service Level Agreement.
