Tenant shall be solely responsible for the safe and secure storage, transportation, and ultimate disposal of all spent nuclear fuel generated at the Nuclear Facility in accordance with all applicable federal laws and regulations, including the Nuclear Waste Policy Act, as amended, and any successor legislation.
Tenant shall be solely responsible for the complete radiological decontamination and remediation of the Nuclear Facility and the Premises to levels that comply with all applicable NRC Regulations and other applicable environmental laws.
Notwithstanding anything in Section 7.03 to the contrary, Tenant shall establish and maintain, in accordance with NRC Regulations, adequate financial assurance in a form acceptable to the NRC and reasonably acceptable to Landlord, to ensure the availability of sufficient funds to complete the decommissioning of the Nuclear Facility.
Tenant shall commence the Reclamation Obligations with respect to any Improvement prior to the earlier of (i) the expiration of the useful life of such Improvement, or (ii) (A) with respect to any Nuclear Facility, within sixty (60) months prior to the expiration of the Term of this Lease, and (B) with respect to all other Improvements, within twenty-four (24) months prior to the expiration of the Term of this Lease.
If, and only if, Tenant constructs a Nuclear Facility on the Premises, Tenant shall pay an additional $9,000,000 (for a total of $19,000,000) annually into the Sinking Fund or such greater amount as may be required by the NRC; provided, however, that, notwithstanding the foregoing, except as otherwise may be required for Tenant to provide necessary funding assurances as described in Section 7.01(b)(ii), the Sinking Fund balance shall not exceed $10,000,000,000 (inclusive of accrued interest).
