Upon the Parties’ determination that additional hardware is required beyond what is included within the NRE Fee above, Motricity shall provide firm quote and if AT&T accepts such firm quote, then AT&T shall pay Motricity pursuant to a separate Work Order (“Incremental Hardware/Maintenance Fees”).
In consideration of Foxconn’s development services as set out in Section 4 of this SOW, Purchaser shall be obliged to pay the following NRE Fee to Foxconn.
