Examples of Non-Payment Event of Default in a sentence
The Company at any time may require a Paying Agent to pay all money held by it to the Trustee, and the Trustee may at any time during the continuance of any Payment Default or Non-Payment Event of Default, upon written request to a Paying Agent, require such Paying Agent to forthwith pay to the Trustee all sums so held in trust by such Paying Agent together with a complete accounting of such sums.
For the avoidance of doubt, the declaration of a Non-Payment Event of Default in relation to the Affected Tranche will not constitute an Event of Default in relation to other tranches of the Subordinated Notes.
Notwithstanding any other provisions of this Indenture, no Non-Payment Event of Default with respect to Designated Senior Debt which existed or was continuing on the date of the commencement of any Blockage Period initiated by the Representative shall be, or be made, 102 -94- the basis for the commencement of a second Payment Blockage Period initiated by the Representative unless such event of default shall have been cured or waived for a period of not less than 90 consecutive days.
For all purposes of this paragraph, no Non-Payment Event of Default that existed or was continuing on the date of commencement of any Payment Blockage Period shall be, or be made, the basis for the commencement of a subsequent Payment Blockage Period by a trustee or representative for, or holders of, Designated Senior Indebtedness unless such Payment Event of Default or Non-Payment Event of Default shall have been cured for a period of not less than 90 consecutive days.
If the Nationwide Non-Payment Event of Default is of a nature which cannot reasonably be cured within a 30-day period, then such 30- day period shall be extended to 60 days if the cure to such Nationwide Non- Payment Event of Default has been commenced and is being diligently pursued.
