Non-Identifiable Data definition

Non-Identifiable Data shall have the meaning set forth in Section 8.2.6.
Non-Identifiable Data means data which has been compiled, extracted, modified, anonymized or aggregated in such a manner that the individual source of the data cannot reasonably be identified.
Non-Identifiable Data means any and all technical information gathered from Devices which are not directly Customer identifiable, or any aggregated, summarized or statistical non-identifiable data derived from the Customer -specific or other non-identifiable data.

  • Notwithstanding the foregoing, nothing in this Section 8.2.6 shall limit Merck’s use or disclosure of Non-Identifiable Data.

  • Reporting and legal compliance Any Non-Identifiable Data (Non-Personal Information) that has been aggregated or disclosed may not be deleted at the expiry or termination of this Agreement.

  • Notwithstanding the foregoing, nothing in this Paragraph 11(f)(iii) shall limit Merck’s use or disclosure of Non-Identifiable Data.

  • Organon and its Affiliates may use Non-Identifiable Data received from Daré to create data sets (“Research Data Sets”) for Organon’s and its Affiliates’ internal research purposes, and may use and disclose the Research Data Sets for medical research, including research unrelated to the Licensed Products, and any filings of medical research study results with regulatory Governmental Authorities worldwide.


More Definitions of Non-Identifiable Data

Non-Identifiable Data has the meaning set forth in Section 2.6.1.
Non-Identifiable Data means Personal Data that has been de-identified such that it meets the Health Insurance Portability and Accountability Act safe harbor for de-identification of protected health information set forth at 45 C.F.R. § 164.514. Organon will: (a) [***]; (b) use appropriate safeguards to prevent [***]; (c) not use the Research Data Sets to identify any study subject or contact any study subject; and (d) use and disclose Research Data Sets in compliance with Applicable Laws.
Non-Identifiable Data is defined in Paragraph 11(f).
Non-Identifiable Data means data stripped of all data elements that affirmatively identify an individual and which reasonably cannot be used to identify an individual either when combined with publicly available information or through other means.
