• In the event Buyer, Buyer's Affiliates, or Buyer's Authorized Agent detects non-conforming Product, a Non-Conforming Material Report (NCMR) and/or a Corrective Action Request (CAR) shall be provided to Seller.

• Non-conforming material found by RNP will be reported to the Seller on a Non-Conforming Material Report (NCMR) form.

• Packaging of any Used Consumer-Type Portable Batteries may not under any circumstance contain any Non-Conforming Batteries, Other Covered Batteries, or other Non-Conforming Material.

• Non-Conforming Material and/or Out of Process Material Losses will not be included in a yield reconciliation calculation.

• The Credit Note shall be issued within [*] business days of the returned Parts being received by SELLER and shall correspond to LOCAL BUYER's Return Note, referencing the Non-Conforming Material (NCM) number contained therein.

• Non-Conforming Material shall also include any material which may be conforming or acceptable to Contractor but which has been co-mingled with Non- Conforming Material.

More Definitions of Non-Conforming Material

Non-Conforming Material means any Products that, upon delivery to Buyer, an Authorized Third Party or Buyer’s Customer that fails to conform with any requirements of the Agreement.

Non-Conforming Material shall have the meaning set forth in Section 5.2.

Non-Conforming Material in the case of Waste shall mean materials, substances, and containers that (i) do not materially conform to the warranties stated in this Agreement, (ii) do not materially conform to the description or specifications stated in the Purchase Order or Waste Material Data Sheet, or (iii) Vendor's or Vendor’s approved facilities are not permitted by law to store, handle, treat or dispose.

Non-Conforming Material means any material, component, part, assembly, sub-assembly, product and any other item forming part of the Supplies (together referred to as “Items” and separately as “Item”) in which there is an indication by visual inspection, testing, or other information that it may not conform with the requirements, specifications, or standards listed within the Purchase Order for the Supply being delivered to the Purchaser.
