(3) the requirement that a Network Customer execute a Service Agreement, as specified in Section 41.1 (iii) of this Tariff; provided that a Service Agreement shall be required (i) for any Participant initially taking Regional Network Service after the Compliance Effective Date, (ii) if a Participant serves load not physically interconnected with the NEPOOL Transmission System pursuant to Section 43.3 of this Tariff or (iii) if a new facility or upgrade is to be constructed pursuant to Section 44.4 of this Tariff;
