Net Operating Costs definition

Net Operating Costs means the managed routine and extraordinary maintenance and operation of existing programs and facilities, less any associated revenues;
Net Operating Costs means (i) costs of sales excluding the cost of biomass sold, (ii) external supplies and services, (iii) payroll expenses, (iv) other expenses, excluding inventory damage, and (v) other income excluding claim compensations from property damage and inventory damage, and excluding investment grants. Net operating costs is used by investors, analysts and management to evaluate profitability.
Net Operating Costs means the lesser of $3,300 CDN per day or the Company’s actual net operating costs per day for the period commencing on September 11, 2007 and ending on the Closing Date.

More Definitions of Net Operating Costs

Net Operating Costs has the meaning given to such term in the Definitions Agreement.
Net Operating Costs means an amount equal to the sum of the Company’s and its Subsidiaries’ (a) gross revenues minus (b) actual out-of-pocket operating expenses incurred in the Ordinary Course of Business, in each case during the Working Capital Period and excluding any Restructuring Costs.
Net Operating Costs means the total annual cost of operating and maintaining WATERBURY’s system, as reduced by any governmental grants-in-aid received.
Net Operating Costs means the APM (i) costs of sales, excluding the cost of biomass sold, (ii) external supplies and services, (iii) other expenses, excluding inventory damage, and (iv) other income excluding claim compensations from property damage and inventory damage, and excluding investment grants.
Net Operating Costs means the positive difference, if any, between:
Net Operating Costs means the positive difference, if any, between (A) any and all actual, out-of-pocket costs and expenses incurred by Service Provider during the applicable calendar year in connection with the performance and rendering of services that are the same as or substantially similar to the Services to all of Service Provider's clients (including Client), which costs and expenses may include, without limitation or duplication: (1) the salaries, employee benefits and bonuses of its employees; (2) copy costs; (3) administrative overhead; (4) rent for office space; and (5) costs of materials and supplies, minus (B) the actual amount of commissions payable to (or shared by) Service Provider with any third party brokers relating to any such insurance policies (including renewals). Notwithstanding anything contained in this Agreement to the contrary, in no event shall the amount fees, charges, costs, expenses or other compensation charged by Service Provider to all of its clients (including Client) for any and all services (including the Services) provided by Service Provider exceed the actual Net Operating Costs incurred by Service Provider in providing such services. Service Provider represents that, to its knowledge, the rates and other charges payable by Client under this Agreement do not and shall not exceed the market rate for similar services provided to companies of size, nature and business similar to Client. If Client determines that any of the rates and/or other amounts charged by Service Provider under this Agreement shall exceed the market rate for similar services provided to companies of size, nature and business similar to Client, then Client and Service Provider shall negotiate in good faith to adjust such rates and other amounts to market.
