Net Internal Area definition

Net Internal Area means the net internal area of the Proposed Development as calculated in accordance with the Measurement Code. Onerous Conditions means a condition contained in a Planning Permission or in a Planning Agreement which falls within any of the sub-paragraphs of paragraph 2.1 of Schedule 1. Party means a party to this Agreement and “Parties” means more than one Party. Planning Acts means the statutes and statutory instruments from time to time in force relating to town and country planning. Planning Agreement means any planning obligation under the Planning Acts or any other agreement required by the Local Planning Authority to be entered into as a condition of the grant of a Planning Permission.
Net Internal Area means the net internal area (expressed in square feet) of the Premises measured in accordance with the sixth edition of the “Code of Measuring Practice: A Guide for Property Professionals” published on behalf of the Royal Institution of Chartered Surveyors;
Net Internal Area means the net internal area as defined in the Measuring Code.

  • If, at any time during the Term, the Net Internal Area of the Lettable Areas shall change or any other circumstances shall arise which make the calculation of the Service Charge Percentage (whether or not relating to individual items of Expenditure) unreasonable or inequitable, the Landlord shall be entitled to alter the Service Charge Percentage to such other percentage as is fair and reasonable in the circumstances.

Net Internal Area means the total floor area expressed in square feet measured in accordance with the Code of Measuring Practice published on behalf of the Royal Institution of Chartered Surveyors and the Incorporated Society of Valuers and Auctioneers current at the date upon which reference is made to such Code (ignoring any works carried out by or on behalf of any tenant or occupier prior to or during the subsistence of this Lease in existence at the time of such measurement which would reduce such total floor area) and in respect of:
Net Internal Area shall have the meaning given to it by the Code of Measuring Practice published on behalf of the Royal Institution of Chartered Surveyors and the Incorporated Society of Valuers and Auctioneers (Fourth Edition November 1993) or such subsequent Edition as shall be generally used by measurement surveyors and shall be determined from time to time by the Estate Surveyor (as defined in Clause 9.1(k)) (ignoring works carried out by tenants or occupiers during the subsistence of the lease or underlease in existence at the time of such determination)
Net Internal Area means net internal floor area measured in accordance with Definition 3 of the RICS Code of Measuring Practice (6th edition November 2007);
Net Internal Area means the total floor area (expressed in Units of Measurement) measured in accordance with the Code of Measuring Practice;
Net Internal Area or “NIA” means net internal area (expressed in square feet) of the Premises as constructed measured in accordance with the Code;

Net Internal Area has the meaning ascribed to that expression by the Code of Measuring Practice - Fifth Edition (RICS/ISVA) (or if there shall be no such edition or no such expression for the time being the nearest equivalent thereto)
