Net Insurance Recovery definition

Net Insurance Recovery means, with respect to any Person, any insurance proceeds recovered by such Person (or an Affiliate thereof) in respect of Losses, but excluding proceeds to the extent (i) premiums will be adjusted, under the terms of the relevant insurance policy or policies, to reimburse the insurer for the material part of such recovery or (ii) such Person incurs additional costs or expenses because filing the insurance claim with respect to such Losses results in the discontinuation of insurance coverage.
Net Insurance Recovery has the meaning set forth in Section 11.5(a).
Net Insurance Recovery means any insurance proceeds recovered in respect of Losses less, in the case of all insurance other than title insurance, 150% of the annual premium paid in the most current fiscal year in respect of such insurance but shall not include any proceeds under any insurance policy pursuant to which premiums are normally adjusted to reimburse the insurer for any material part of proceeds paid out in previous years.
