DEFINITIONS In this declaration:a) “Claim” means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence but does not include a claim against a Motorcycling Organisation under any right expressly conferred by its constitution orregulation;b) “Indemnitees” means and includes the persons, organisations and bodies corporate whose names appear in Schedule 1.
Sport Integrity Australia may, in managing any part of the Complaints Process, seek any assistance from the Motorcycling Australia Complaint Manager and/or otherwise from Motorcycling Australia or a relevant Motorcycling Organisation it deems appropriate.
The parties to an Alternative Dispute Resolution process will be the Complainant, the Respondent, and Motorcycling Australia or a Motorcycling Organisation (the Parties).
Motorcycling Australia National Integrity Framework applies to all Activities organised or authorised by Motorcycling Australia or a Member Organisation and will be adopted in full by each Motorcycling Organisation.
Employees are expected to abide by the terms of this Framework as a reasonable and lawful direction of Motorcycling Australia or the Motorcycling Organisation they are employed by (as relevant) as their employer.
A Complaint Form may only be submitted on behalf of Motorcycling Australia or a Motorcycling Organisation by the CEO or equivalent of the organisation.
A Complainant can be any person or organisation, including Motorcycling Australia or a Motorcycling Organisation, who has information that an Alleged Breach of an Eligible Policy has occurred.
If the Respondent does dispute the Alleged Breach, the Chair will invite Motorcycling Australia /the Motorcycling Organisation to give evidence and witnesses (if any) shall be called upon to give their evidence in turn, subject to the approval of the number of witnesses to be called by the Tribunal in its discretion.
A Tribunal convened to hear a matter referred under clause8.2(a)(i) (Provisional Action) of the Policy will comprise of a single Tribunal Member appointed by the Motorcycling Australia Complaint Manager who is a person of suitable experience and skills, independent of Motorcycling Australia and (if applicable) Motorcycling Organisation.
Where the Tribunal finds that one or more alleged breaches of an Eligible Policy have been proven, it shall inform the parties of its decision and provide Motorcycling Australia /the Motorcycling Organisation and the Respondent with an opportunity to make submissions as to Sanction (if the parties have not already had an opportunity to make such submissions).
