The Minister of MOFT is designated as representative of the Recipient for the purposes of Section 11.02 of the Grant Regulations.
The Project Implementing Entity shall ensure that a Project Director, with terms of reference and qualifications satisfactory to the Association, is maintained throughout the implementation of the Project, to oversee the implementation of Parts A.2(b), (c), (d), B and E of the Project as well as the financial management and procurement aspects of the entire Project, and for coordinating the overall implementation of the Project with the Project co-directors from MOFT and MOHF.
To this end, the Recipient shall carry out Parts A.1, A.2 (a), (c) and (d), and B of the Project through the MOHF and Parts A.2 (b) and A.3 through the MOFT in accordance with the provisions of Article IV of the General Conditions.
The Beneficiary hereby designates MOFT as its agent for the purposes of taking any action or entering into any agreement required or permitted under Sections 3.02, 3.03 and 3.05 of this Financing Agreement and under Sections 5.01, 5.02, 5.03 and 5.04 of the Loan Regulations, and Sections 5.01, 5.02, 5.03 and 5.04 of the Grant Regulations.
MOFT shall have completed a comprehensive internal audit manual based on a risk-based auditing consistent with the public accounting system.
The authority conferred on MOFT under Section 7.01 of this Financing Agreement may be revoked or modified by agreement between the Beneficiary and ADB.
MOFT shall have developed medium term sector roadmaps based on the goals of the National Development Strategy with clear objectives and policies and results- based monitoring framework to measure how programs can effectively meet sector objectives.
Any action taken or any agreement entered into by MOFT pursuant to the authority conferred under Section 7.01 of this Financing Agreement shall be fully binding on the Beneficiary and shall have the same force and effect as if taken by the Beneficiary.
The Recipient, through MDPAC, shall establish by September 30, 2007, and maintain until completion of the Project, the Program Steering Committee, including Permanent Secretaries from MDPAC, MOFT, MAL, MID, MPGRD and the Provincial Secretaries of Participating Provinces.
The Recipient shall maintain, throughout the period of the implementation of the Project, a Project Technical Committee to be chaired by a project director, including representatives of MOHF, MOFT, CSC and CMDA, to facilitate coordination and implementation of the Project implementation, including sharing information related to pension fund reforms and resolving any implementation issues; the mandate, terms of reference and composition of such committee shall be satisfactory to the Association.
