Nothing contained in or arising out of this Agreement shall be deemed to constitute any representation or warranty by the Authority that there is, or is likely to be, any Minewater within the Area and the Operator acknowledges that this Agreement has not been entered into in reliance wholly or partly on any statement or representation made by or on behalf of the Authority.
No statement shall be made nor advertisement, notice, prospectus or other document issued by the Operator claiming or suggesting (whether expressly or impliedly) that the Authority has expressed an opinion that the Area, or any part of it, is, from its geological formation or otherwise, one in which Coal or Minewater is or is likely to be obtainable or utilised for the purposes of heat recovery.
Subject to the terms of this Agreement, the Authority grants to the Operator, its contractors and agents permission to enter (by means of boreholes only) the Coal, Coal- Mine and any other underground minerals which are vested in the Authority [at a depth below the surface of greater than [xx metres] down to a depth of [words (numbers)] metres below the [Name] Seam] within the Area for the Duration for the purpose exclusively of heat recovery from Minewater.
