  • The provisions of the Merck License Agreement set forth on Exhibit 10.4 attached hereto are specifically incorporated herein, with the terms used therein that are defined in the Merck License Agreement having the same meanings as ascribed to such terms in the Merck License Agreement, and Company shall comply with such provisions during the Merck Term as if Company were TESARO thereunder.
