Medical Liability Claim definition

Medical Liability Claim means a claim, lawsuit or cause of action (arising within the Plan territory) based upon treatment, or lack of treatment within the United States of America, its territories or possessions, or Canada, or other claimed departure that departs from accepted standards of medical or dental care which proximately results in injury to or death of a the Participant's patient, whether the claim or cause of action sounds in tort or contract, subject to the exclusions described in Article V, Section 4, below. C. Disciplinary and Licensing Actions means any disciplinary, licensing, or similar administrative proceeding brought against a Participant by the Texas State Board of Medical Examiners or Texas State Board of Dental Examiners that arises from professional services, except those excluded pursuant to Article V, Section 4.

  • Liability Claim has the meaning set forth in Section 7.2(a).

  • Third Party Claims has the meaning set forth in Section 11.1.

  • Third party claimant means any individual, corporation, association, partnership, or other legal entity asserting a claim against any individual, corporation, association, partnership, or other legal entity insured under an insurance policy or insurance contract.

  • D&O Liability Insurance Policies means all insurance policies (including any “tail policy”) of any of the Debtors for liability of any current or former directors, managers, officers, and members.

  • Third Party Infringement Claim has the meaning set forth in Section 6.4.

  • Fraud Claim means any claim based in whole or in part upon fraud, willful misconduct or intentional misrepresentation.

  • De Minimis Claim has the meaning set forth in Section 7.4(a).

  • Retained Environmental Liabilities means all Environmental Liabilities of Seller or its Affiliates arising out of or relating to operations or activities that are not primarily related to the Business, whether arising or related to the period before or after Closing.
