Material Owned Real Property definition

Material Owned Real Property means any Mine or other real property, in each case, owned or acquired in fee by any Loan Party having a fair market value in excess of $1,000,000.
Material Owned Real Property shall have the meaning assigned to such term in Section 3.20(a).
Material Owned Real Property means any Real Property, or group of related tracts of Real Property, acquired (whether in a single transaction or a series of transactions) or owned in fee by any Loan Party, in each case, in respect of which the fair market value (including the fair market value of improvements owned or leased by such Loan Party and located thereon) on such date of determination exceeds $1,000,000.

More Definitions of Material Owned Real Property

Material Owned Real Property means each parcel of Real Property located in the United States which is acquired after the Closing Date by a Loan Party with a fair market value in excess of $2,500,000.

Material Owned Real Property means (i) as of the Issue Date, all Real Property consisting of a fee or surface estate located in Tuscaloosa County or Jefferson County, Alabama owned by the Issuer or any other Grantor that is essential to the Issuer’s mine plan or surface operations (including the transportation and/or shipping of coal, support for mining activities and maintenance of underground and surface equipment) for the period from the Issue Date to the Stated Maturity of the Notes as determined by the Issuer on the Issue Date in its reasonable judgment, and (ii) any other Real Property consisting of a fee or surface estate that the Issuer or any other Grantor acquires an ownership interest in after the Issue Date for the purpose of mining or conducting mining operations on such Real Property (including, without limitation, extraction of coal and other minerals and the processing and transport thereof) the fair value of which, as of the date of acquisition thereof, is equal to or greater than $10.0 million as determined by the applicable tax assessor.
Material Owned Real Property means any owned real property of a Loan Party that has a value in excess of $5,000,000.
