Malfunctioning system definition

Malfunctioning system means a system which is not adequately renovating or hydraulically eliminating the wastewater it is receiving as evidenced by, but not limited to, the following conditions:
Malfunctioning system means any subsurface sewage disposal system that exhibits a condition or conditions which, if not timely corrected, will, in the judgment of the commissioner, result in a failed system. Backflow from leaching system into septic tank, wastewater overflowing the outlet baffle, back-up into the building sewer or riser, or evidence that the system is not performing as designed, is an indication of a "malfunctioning system."
Malfunctioning system means an individual sewage disposal system which pollutes ground or surface waters or which creates a nuisance or hazard to public health or safety or the environment and includes, but is not limited to, the situations described in N.J.A.C. 7:9A-3.4.
