Loan and Servicing Agreement means that certain Loan and Servicing Agreement, dated as of January 22, 2010, by and among Ares Capital CP Funding LLC, as the Borrower, the Seller, as the Servicer and the Transferor, Xxxxx Fargo Bank, National Association, as the Swingline Lender, each of the Lenders from time to time party thereto, Xxxxx Fargo Securities, LLC, as the Agent, and U.S. Bank National Association, as the Trustee, the Bank and the Collateral Custodian, as such may be amended, restated, supplemented or otherwise modified from time to time pursuant to the terms thereof.
