Liquidation Estate definition

Liquidation Estate means the assets of CD vesting under the control of the Liquidator, and over which the Liquidator has rights to deal with the same in accordance with the provisions of IBC, Liquidation Process Regulations and applicable laws.
Liquidation Estate means, an estate of the assets in relation to the corporate debtor formed by the liquidator under Section 36(3) of the IBC;
Liquidation Estate means the Liquidation Estate established by the Liquidator pursuant to the provisions of Section 36 of the Code and as provided in Clause 7 read with Clause 8 of this Memorandum;

Examples of Liquidation Estate in a sentence

  • Any asset lying at any premises/property of the company and not part of Liquidation Estate shall not be covered in any Block under this document and will not be available for sale/transfer.

  • Provided that where an asset is subject to security interest, it shall not be sold under any of the clauses (a) to (f) unless the security interest therein has been relinquished to the Liquidation Estate.

  • The proposed sale of Assets does not entail transfer of any title except the title which the Company had on the assets as on date of transfer i.e. relinquished assets being part of Liquidation Estate of the Corporate Debtor.

  • The Liquidator has the control of the Assets and Properties of the Corporate Debtor, including the assets and properties, in which the Financial Creditor held the security interest and since relinquished to the Liquidation Estate of Corporate Debtor.

  • Sale of Assets and Properties owned by Gajanan Oil Pvt Ltd (in Liquidation) forming part of Liquidation Estate, by the Liquidator, appointed by the Hon’ble NCLT, Mumbai Bench vide order dated 12th February 2020.

  • The Liquidator reserve the right to reject all or any of the Bidders or their Bid(s) without assigning any reason whatsoever, respectively for the assets forming part of the Liquidation Estate.

  • Any proceeds received on account of the applications filed under these sections 43, and 66 shall not form part of the liquidation sale of Corporate Debtor as going concern under this E-Auction; however, shall be part of the Liquidation Estate for distribution as per section 53 of the Liquidation Regulations.
