Licensed GLA Product definition

Licensed GLA Product means any product that contains Immune Design GLA: (a) the making, using, importing, offering to sell or selling of which by Immune Design, its Affiliates or sublicensees would, but for the licenses granted herein, infringe any Valid Claim of any Licensed GLA Patent (treating, for such purpose, pending Valid Claims as if they had issued); or (b) that results from or uses the practice of Licensed Know-How or IDRI FMC Technology.

Examples of Licensed GLA Product in a sentence

  • If an allegation is made or claim is brought by a Third Party that any activity related to a Licensed GLA Product infringes the intellectual property rights of such Third Party, the Party who becomes aware of such allegation will give prompt written notice to the other Party.
