A Lesser Price Plan is any one of the following: (a) for smart phones, any plan that is less than $19.99 per month, plus required data feature (voice and data bundles qualify) after any applicable discounts; (b) for internet devices, any plan that is less than $19.99 per month after any applicable discounts; or (c) for basic phones, any plan that is less than $14.99 per month after any applicable discounts.
If the Eligible Entity moves the Equipment to a Lesser Price Plan (as defined below), or disconnects the Equipment from the Verizon network, at any time during the first 24 months after the Equipment is activated, the Eligible Entity must pay an Offer Recovery Fee (as defined below).
If the Customer fails to activate the Equipment under the designated price plan within thirty (30) days following delivery, or, at any time during the first 24 months after the Equipment is activated, moves the Equipment to a Lesser Price Plan or disconnects the Equipment from the network, the Customer shall pay an Offer Recovery Fee (as defined below).
