LDAR Settlement Obligations definition
LDAR Settlement Obligations means the payment of fines and penalties in connection with the resolution and settlement of matters set forth and described in USEPA Compliance Order CAA-02-2008-1006 and New Jersey Department of Environmental Protection’s Administrative Orders and Notices of Civil Administrative Penalty Assessments No. 070002-18058, and No. 090005-18 but excludes all other costs and/or performance obligations that may be required from and after the Closing Date including, without limitation, all future enhanced LDAR monitoring and activities based on Buyer’s use of the Facility.
