Landlord's Cost definition

Landlord's Cost for redistributed electricity means the product of (1) Landlord’s Cost Rates for the relevant Utility Billing Period multiplied by (2) Tenant’s electricity consumption (i.e., energy and demand) based on the meter readings referred to below.
Landlord's Cost means, the then going cost per kilowatt hour and kilowatt to Landlord of purchasing electricity, from the Electricity Providers (herein defined) as adjusted from time to time for fuel adjustment charges, rate adjustment charges, sales tax, and/or any other factors.
Landlord's Cost shall be deemed to mean Landlord's out-of-pocket contract or purchase price for materials, labor and services (including, without limit, any reasonable contractor's fee for the contractor's overhead and profit and charges for cutting, patching, cleaning up and removal of waste and debris), plus architects' and engineers' fees, plus the product obtained by multiplying all of the foregoing (as reduced by appropriate credits for substituted Standard Tenant Work) by ten percent (10%) for Landlord's expenses and profit in handling the substitution. Notwithstanding anything herein, Tenant's telephone and data wiring and cabling (hereinafter called the "Direct Tenant Work") shall be installed in accordance with the Tenant Construction Plans by contractors contracting with Tenant and not with Landlord.

  • In the event Landlord's Cost is less than $550,000.00, then Increased Rent shall be recalculated utilizing the formula set forth above and the payment of Increased Rent shall be correspondingly adjusted.

  • Landlord shall, at Landlord's option, furnish and 34 install all replacement lighting, tubes, lamps, starters, bulbs and ballasts required in the Demised 35 Premises and Tenant shall pay to Landlord (or its designated contractor) Landlord's Cost therefor as 36 additional rent within thirty (30) days after delivery of Notice with an invoice therefor.

  • Upon presentation of the final invoice, the total amount of the Landlord's Cost shall be subject to verification by Tenant, and Tenant shall have reasonable access to Landlord's cost records relative thereto.

  • If Tenant fails to give Landlord an Objection Notice within the 60 day period or fails to provide Landlord with a Review Notice within the 90 day period described above, Tenant shall be deemed to have approved Landlord's Cost Statement and shall be barred from raising any claims regarding the Actual Operating Cost for that Lease Year.


More Definitions of Landlord's Cost

Landlord's Cost means, the average cost per kilowatt hour and average cost per kilowatt demand, by time of day, if applicable, to Landlord of purchasing electricity for the building, including, without limitation, fuel adjustment charges (as determined for each month of the relevant period and not averaged) rate adjustment charges, sales tax, and/or any other factors, used by the public utility company (the "Utility") servicing the building in computing its charges to Landlord applied to the kilowatt hours of energy and kilowatts of demand purchased by Landlord during a given period, and further including transmission and transformer losses (to be determined by Landlord if such losses are not measured by the Submeter, as defined herein); and
Landlord's Cost means all costs and expenses incurred by Landlord in connection with the completion of the Tenant Improvements, including, without limitation: (i) Landlord’s out-of-pocket contract or purchase price(s) for materials, components, labor and services plus (ii) an amount equal to three percent (3%) of the hard costs described in (i), as Landlord’s construction management fee, plus (iii) Tenant’s Design Consultants’ fees in excess of the Test-Fit Allowance, plus (iv) fees for all required permits and approvals. Upon completion of the Tenant Improvements, Tenant shall cause Tenant’s Design Consultants to provide Landlord with redlined drawings via CAD showing “as built” conditions. Tenant may designate an individual to be present when the bids are first opened, and to facilitate in the bid process, including the opportunity to negotiate, refine and evaluate such bids. Landlord shall accept bids on all work for the Tenant Improvements on a guaranteed maximum sum bid from a licensed general contractor selected by Tenant and at least two (2) licensed general contractors of Landlord’s choosing. The cost charged for the Tenant Improvements shall not exceed the lowest bid received that satisfies all of the construction requirements identified in the Final Plans, (and the projected timing established for the completion of the Tenant Improvements) except for subsequent changes due to field conditions, qualifications and/or changes initiated by Tenant (in which case the cost of such work shall be limited to the actual cost plus a pre-negotiated xxxx-up for overhead and profit, which xxxx-up shall be shared with the contractors at the time the bid packages are disseminated). Tenant may not request a change to the Final Plans if such change will extend the estimated timing for Substantial Completion unless Tenant agrees in writing to stipulate that for purposes of calculating the Rent Commencement Date, the Commencement Date shall be the date the Tenant Improvements would have been Substantially Complete, but for such change. Landlord shall provide a one (1) year warranty against defective or non-conforming work, and shall pass through and assign to Tenant any warranties received by Landlord from the contractors or subcontractors. Landlord shall repair and replace, as necessary, any defective work and materials or work and materials not in conformance with the Final Plans which is identified by Tenant in writing on or before the first anniversary of the Commencement Date.
Landlord's Cost means, in connection with the performance by Landlord and/or 2 Landlord's managing agent (or any third party designated by Landlord or Landlord’s managing agent) of 3 any work or service on behalf of Tenant pursuant to the terms of this Lease (including to the extent 4 applicable pursuant to the Rules and Regulations Regarding Alterations attached hereto as Exhibit C),
Landlord's Cost means amounts charged by Landlord's contractor; subcontractors and materialmen for furnishing and installing any item or performing any work, including, without limitation, labor costs and costs for general conditions in connection therewith (which general conditions shall include, without limitation, rubbish removal, hoisting and other items generally included within the term "general conditions" in the Metropolitan New York Area.
