Further, the Parties represent and agree that they have knowingly and voluntarily entered into this Agreement, that they have been given a reasonable period of time to discuss all aspects of this Agreement and the effect of the Agreement with their attorneys, and that they fully understand all of the provisions of the Agreement.

  • Knowing and "knowingly" means that a person is in possession of facts under which he or she is aware or should be aware of the nature of his or her conduct and that his or her conduct is substantially certain to cause the payment of a medicaid benefit.
