Japanese Borrower definition

Japanese Borrower means any Japanese Subsidiary that has been designated as such pursuant to Section 2.20 and that has not ceased to be a Japanese Borrower as provided in such Section.
Japanese Borrower means any Borrower that is organized under the Laws of Japan.
Japanese Borrower shall have the meaning set forth in the preamble and, when used to describe the Borrowers who are permitted to borrow under the Japanese Commitment, also shall mean and include any Borrowing Subsidiary organized and existing under the laws of Japan.

  • The Japanese Borrower represents and warrants to the Yen Revolving Lenders that, as of the date of this Agreement, it falls into Article 2, Paragraph 1, Item 1 of the Act on Specified Commitment Line Contract (Act No. 4 of 1999).

  • Committed Japanese Loans shall be made in Yen and shall be either Japanese Base Rate Loans or TIBOR Rate Loans, as the Japanese Borrower or the Parent, on behalf of the Japanese Borrower, may request subject to and in accordance with this Section 2.02.

  • Notwithstanding anything to the contrary in this Article IV, the Japanese Borrower shall only be liable for amounts owing under this Article IV in connection with its Loans and other Obligations.
