The Official Sea Trial is to be carried out in Hong Kong. “Payload” or “payload” means weight of person(s), personal protective equipment, personal effects, and other device(s) and item(s) carried by the person(s). “Product Warranties” means all Warranties concerning the Vessel, the Equipment and the Deliverables including without limitation those specified in Clauses19.1.10 to 19.1.19 of Conditions of Contract. “Proprietary Made” means in relation to a piece of Equipment, it is not manufactured by the manufacturer of the Vessel itself, but is one that is manufactured by a third party manufacturer whose business is manufacture of such Equipment. “Punchlist Items” means defects or outstanding Work not affecting the operation or diminish the safety standard, which MD, in its discretion, is willing to leave temporarily unrectified for the purpose of undergoing technical acceptance tests and trials commenced or, as the case may be, allowing a Delivery Acceptance of the Vessel. “Ready for Use” or “Ready to Use” means in case of the Vessel, or any Equipment or any Deliverable, that the same having been fully designed, properly constructed or installed or supplied in full accordance with all terms and conditions of the Contract including without limitation the Warranties, the Technical Specifications and the Schedules, and in the case of Equipment, having been fully ins...
