INOPERABLE MOTOR VEHICLES definition

INOPERABLE MOTOR VEHICLES means any motor vehicle which, for a period of at least seven (7) days, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power. “Inoperable Motor Vehicle” shall not include a motor vehicle which has been rendered temporarily incapable of being driven under its own motor power in order to perform ordinary service or repair operations. 25-4-2 DECLARATION OF NUISANCE. All inoperable motor vehicles, whether on public or private property in view of the general public, are hereby declared to be a nuisance. 25-4-3 NOTICE TO OWNER. The Police Chief or a designated representative shall notify the owner of the motor vehicle, informing him that he shall dispose of any inoperable vehicles under his control. If the owner fails to dispose of said inoperable vehicle(s) after seven (7) days from the issuance of the notice, the Police Chief or a designated representative may authorize a towing service to remove and take possession of the inoperable vehicle or parts thereof. 25-4-4 EXCLUSIONS. Nothing in this Article shall apply to any motor vehicle that is kept within a building when not in use, to operable historic vehicles over twenty-five(25) years of age, or to a motor vehicle on the premises of a licensed business engaged in the wrecking or junking of motor vehicles. INOPERABLE MOTOR VEHICLES means motor vehicles which by reason of dismantling, disrepair or other cause are incapable of being propelled under their own power or are unsafe for operation on the streets and highways of the state because they do not comply with the State Motor Vehicle Code.

It shall be a violation of this Article for any person to knowingly store or park or allow to store or park a motor vehicle on private property without having a valid, or current, registration displayed on the vehicle. 25-5-3 DECLARATION OF NUISANCE. All inoperable motor vehicles, whether on public or private property in view of the general public, are hereby declared to be a nuisance. 25-5-4 NOTICE TO OWNER. The Police Department shall notify the owner of the motor vehicle informing him/her that he/she shall dispose of any inoperable or unlicensed vehicle(s) on or before the expiration of five (5) days after issuance of the Notice, or the Police Department may authorize a towing service to remove and take possession of the inoperable and unlicensed vehicle or parts thereof. It shall be necessary for the corporate authorities to issue one (1) Notice to Abate per owner in any one (1) calendar year time frame. In the event of additional recurring violations by the same owner, a new Notice to Abate shall not be required by rather the Chief of Police or his designate shall authorize a complaint to be signed for violation of this Article. 25-5-5 EXEMPTIONS. All businesses licensed to do, but not limited to, mechanical repair, body repair, electrical repair, towing service, glass repair, tire repair are exempt from the above ordinance and may have inoperable or unlicensed vehicles parked on their property pending repair work.
