Contractor will comply with all laws and standards with respect to the access, use, protection, disclosure, and storage of such PII/PHI, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Standards for Privacy of Individually Identifiable Health Information (“Privacy Rule”)(45 C.F.R. Parts 160 and 164) under HIPAA.
Individual Exchange –Covered California through which Qualified Individuals may purchase QDPs. Individually Identifiable Health Information (IIHI) – The “individually identifiable health information” as defined under HIPAA.
As used herein, the term “Protected Health Information” shall include, without limitation, any and all individually identifiable health information that is transmitted by, or maintained in, electronic media or any other medium, as defined by the HIPAA Standards for Privacy of Individually Identifiable Health Information and the Federal Security Standards contained in 45 C.F.R. Parts 160 and 164, all as may be amended from time to time.
Terms used, but not otherwise defined, in this BA Agreement shall have the same meaning as those terms in the federal Standards for Privacy of Individually Identifiable Health Information, 45 C.F.R. Parts 160 and 164 (the “Privacy Rule”) and the federal Security Standards, 45 C.F.R. Parts 160 and 164 (the “Security Rule”), and Breach Notification Standards, 45 C.F.R. Parts 160 and 164, as they may be amended from time to time (collectively, the “HIPAA Rules”).
XXXXX agrees to comply with the Standards for Privacy of Individually Identifiable Health Information found at 45 CFR Part 160 and Part 164, Subparts A and E (collectively, the “Privacy Rule”); and both Parties intend to protect the privacy and provide for the security of Individually Identifying Health Information disclosed pursuant to the terms of this Agreement.
