The Customer agrees that delivery of interest on the original investment amount of the Designated Product shall be subject to the terms and conditions of the Indicative Term Sheet or the Transaction Notice for Investment Products.
If there is any adjustment to the terms as set out in the Indicative Term Sheet which is considered essential or appropriate by the Bank at its absolute discretion on or before the designated Initial Date (including without limitation, market fluctuation or events leading to increase of risk), the Bank is entitled, at its absolute discretion, to make any adjustment to the Designated Product.

If any item set out in the Transaction Notice for Investment Products is inconsistent with or different from these Terms and the Indicative Term Sheet, the Transaction Notice for Investment Products shall prevail.
Borrower shall provide the Bank prior written notification of any material changes or modifications to the Credit Suisse credit facility issued pursuant to an Indicative Term Sheet dated on or about April 19, 2013.
Because the Indicative Term Sheet represents indicative but non- binding terms, the provisions in the Final Fund Documents may differ from, and will supersede, those in the Indicative Term Sheet.
