Indenture Trustee Fees definition

Indenture Trustee Fees means the compensation, fees, expenses, disbursements, and indemnity claims of the Indenture Trustee, including, without limitation, any fees, expenses, and disbursements of attorneys, advisors, or agents retained or utilized by the Indenture Trustee, whether prior to or after the Petition Date and whether prior to or after the Effective Date.
Indenture Trustee Fees means the compensation and expenses (including attorney’s fees and expenses and indemnification payments) payable to the Indenture Trustee for its services under this Master Indenture and the other Relative Documents to which it is a party (if any).

  • Upon such notification, the applicable Indenture Trustee may (i) assert its Indenture Trustee Charging Lien to pay the disputed portion of the Indenture Trustee Fees or (ii) submit such dispute for resolution to the Bankruptcy Court.

More Definitions of Indenture Trustee Fees

Indenture Trustee Fees means, collectively, to the extent not previously paid, all outstanding, reasonable and documented fees and expenses of the Indenture Trustees (including, without limitation, attorneys’ and agents’ fees, expenses, and disbursements) to the extent permitted under the applicable indenture regardless of whether such fees were incurred before or after the Petition Date.
Indenture Trustee Fees means the reasonable and documented compensation, fees, expenses, and disbursements of each of the Indenture Trustees and each paying agent (as applicable) in connection with the Chapter 11 Cases and under each applicable indenture or bond agreement, including without limitation any fees, expenses, and disbursements of attorneys, advisors, or agents retained or utilized by any of the Indenture Trustees in connection with the Chapter 11 Cases.
Indenture Trustee Fees means the reasonable compensation, fees, expenses, disbursements, and indemnity claims arising under the applicable Indenture, including attorneys’ and agents’ fees, expenses, and disbursements, incurred under the applicable Indenture by any of the Indenture Trustees, whether prior to or after the Petition Date and whether prior to or after the Consummation of the Plan; provided, however, that the Indenture Trustee Fees shall not include any fees or expenses incurred by the Senior Secured Notes Trustee in connection with litigating the entitlement to payment of interest at the default rate as payment of that certain makewhole premium, as defined in section 1.1 of the Senior Secured Notes Indenture. Nothing in the foregoing or any other provision of this Plan shall in any way limit, impair, or affect the Senior Secured Notes Trustee’s rights under the Senior Secured Notes Indenture to the reimbursement of costs, including the reasonable compensation and expenses, disbursements, and advances of the Senior Secured Notes Trustee’s agents, counsel, accountants, and experts.
Indenture Trustee Fees means the fees and expenses, including, without limitation, attorneys' and agents' fees, expenses and disbursements, incurred by the Indenture Trustee, prior to and after the Petition Date and through the Effective Date in accordance with the terms of the related Indenture, which shall be an Allowed Administrative Claim and be paid in full by the Debtors on the Effective Date.
